Rule 76
<br> to be a potential candidate for promotion (1) In the case of gazetted posts, in order to be promoted in civil service, group or sub-group vacant posts by performance evaluation and seniority and performance evaluation, employees with the minimum service period and educational qualification as per section 21 of the relevant service, group or sub-group under the relevant service, group or sub-group in the case of gazetted posts. For the gazetted first class vacancy of the court and the public prosecutor's office, the employees of the relevant service, group, who have reached the service period of the court and the public prosecutor's office in the relevant district.
(2) Employees below one category who have completed the service period of all the offices of the relevant service, group or sub-group for the vacant gazetted first category post, except as mentioned in sub-section (1).
(2) Notwithstanding anything written in sub-rule (1), the following employees having the educational qualification and service period as per sub-section (2) of section 24D1A of the Act shall be eligible candidates for promotion to the gazetted second class vacant post through seniority and performance evaluation:-
(a) For the vacancies in the office as per clause (a) of sub-rule (1) of all ministries, secretariats, commissions, departments or central level offices unlisted in the gazette of the fifth category or without category.
(b) Sub-rule (1) aFor the vacancies in the office as per Clause (b), the employees of the fifth category or no category listed in the gazette of all the offices in the respective district.
(3) Notwithstanding anything written in sub-rules (1) and (2), even if a civil servant is transferred to another office before the post-filling percentage is determined in accordance with rule 14 and the number of posts for promotion is allocated, he/she will be assigned to the post allocated in the previous office (before transfer). Potential candidates for promotion will not be excluded. Explanation:- For the purpose of this rule, "central level office" means an agency or office located in Kathmandu Valley, which has jurisdiction over Nepal and is headed by at least a gazetted second class official.
